Photo Request from World Wildlife Fund - USA

Dear SCOBA Webmaster:

I am writing on behalf of the World Wildlife Fund in the United States. WWF-US and National Geographic Society are in the midst of a project which involves describing, mapping and photographically representing 867 Terrestrial Ecoregions of the World.  These ecoregions are divided based upon geography, climate, soils, and vegetation. The website will include
technical descriptions, species lists, educational excerpts, and photographic depictions of each ecoregion.  The information will be published on an educational Web site early in the coming year.

We are particularly interested in using photos of Hunan Province forest areas from your  website (http://www.zaptron.com/china/photos98/hunan/hunan19.htm).   We understand the photos are courtesy of SCOBA and would like permission to use them. You will be given author credit for any photos that are used on the web site and any images will be used for educational purposes only.

Dear Dongping Zhu,

Thank you again for donating your pictures to the World Wildlife Fund/National Geographic Society Wild World web site (www.worldwildlife.org/wildworld).   This is an important conservation project aimed at increasing biogeographic literacy and catalyzing interest in the natural world.  The main web page will be linked to 867 terrestrial ecoregion pages and 238 Global 200 priority ecoregion pages.   Every school in the United States will be sent 10 ecoregion maps and teachers guides to get students interested in visiting the web page.  Each ecoregion page will include educational descriptions highlighting important biodiversity features of the ecoregion and a summary of the conservation situation.  The technical descriptions detail the biology and status of each ecoregion. There also will be one or more photographs depicting the natural habitat of each ecoregion.  It has been a Herculean task to gather photographs of natural habitats of the world. We could not have accomplished as much as we have without your willingness to contribute your images. 

We are obliged to verify that you understand that we are planning to use your photograph(s) for this project and that you give your consent for the use of your images.  You will be given photo credit for each photo that you have donated.  The page is a non-commercial/ educational website; however, we feel it is important to inform you that sponsoring corporate logos will appear on the page.  These are corporations that have made significant monetary contributions which have made the publication of this information possible. Our program has confirmed with WWF and NGS colleagues that the website is educational and non-commercial.

We know that all of you are very busy, but we ask you if you can to please read the following agreement, type your name in the signature space, and return the e-mail if you agree to all of the terms and conditions. The consent agreement is a standard template we use for photo consent.  Please contact us if you have any questions.

NONEXCLUSIVE PHOTOGRAPH LICENSE

December 18, 2000

This will confirm the agreement pursuant to which World Wildlife Fund, Inc. (WWF) and the WWF network have acquired the perpetual, worldwide, non-exclusive, royalty-free rights to publish, upon the terms and conditions set forth below, the photograph or photographs that Dr. Dongping Zhu provided to us this year.

1. WWF is granted the following rights with respect to the photographs:

a) The right to publish the photographs on the World Wide Web as part of the Wild World educational web site created by WWF in association with National Geographic Society, underwritten by Ford Motor Company; b) The right to crop and otherwise alter and edit the photographs, as WWF deems appropriate, to fit space or to enhance the function or effectiveness of use of the photographs.

2. Dr. Dongping Zhu shall retain any and all other rights in and to the photographs.

3. The undersigned warrants and represents that the photographs are original and created by Dr. Dongping Zhu, that publication thereof will not violate or infringe any copyright or proprietary right or right to privacy of any individuals.  Dr. Dongping Zhu shall indemnify and hold harmless WWF and its licensees from any claim, damage, loss or expense
(including reasonable attorneys' fees) arising out of any breach or any allegation which if true would constitute a breach of any foregoing warranties or representations.

4. WWF shall credit Dr. Dongping Zhu  as the photographer in the publication of the photographs.

5. In creating or furnishing the photograph(s), Dr. Dongping Zhu shall be acting as an independent contractor and not as an agent or employee of WWF. Any associate or assistant retained by Dr. Dongping Zhu in connection with furnishing the photographs shall be at the cost and expense of Dr. Dongping Zhu and will not, in any event, be or be deemed to be an agent or employee of WWF.

Please confirm that the foregoing accurately and completely sets forth our agreement by signing and returning the enclosed copy hereof.
